Distant Sales Contract
This Distance Sales Contract is prepared in accordance with the Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures for Distance Contracts, published in the Official Gazette of the Republic of Turkey on 13.06.2003, issue number 25137. By completing your purchase, you are deemed to have read and accepted all terms herein.
This contract governs the rights and obligations of the parties in connection with the sale and delivery of products ordered by the Buyer from the Seller's website. The characteristics and sale price of the products are as specified on the website at the time of order.
Seller
Buyer
This agreement covers the sale and delivery of products ordered electronically through www.myfirstjewelry.com. The Buyer acknowledges having reviewed the preliminary information including product characteristics, sale price, payment method, and delivery conditions, and confirms acceptance of these terms prior to placing an order.
The preliminary information page and invoice issued by the Seller are integral parts of this agreement. The agreement enters into force upon electronic approval by the Buyer at the time of order.
My First Jewelry offers fine jewelry and accessory products for children. Product details including materials, dimensions, color, and pricing are provided on each product page.
The Seller is responsible for delivering the contracted product in sound, complete condition and in accordance with the specifications stated in the order, together with any applicable warranty documents.
Products will be delivered to the address provided by the Buyer within a maximum of 30 days from the date of order. This period may be extended by up to 10 additional days, provided the Buyer is notified in advance. If the Seller is unable to supply the product within this period, the Buyer will be informed and a full refund will be issued within 10 days.
Delivery will be made via the Seller's chosen carrier to the address specified at checkout. If the Buyer or the designated recipient is absent at the time of delivery, responsibility for any resulting costs or re-delivery arrangements lies with the Buyer.
Upon receiving a package, the Buyer is advised to inspect it in the presence of the delivery agent. If visible damage is found, the package should not be accepted and a damage report should be filed with the carrier. The Seller must be notified within 3 days, with a copy of the report. The Seller will arrange a replacement delivery as soon as possible.
For international shipments, there is no shipping charge. Customs duties, insurance, and any other applicable fees for international orders are borne by the Seller.
Return shipping costs are covered by the Seller. A prepaid return label will be sent to the Buyer. If the item is not returned in its original condition, the Buyer is responsible for any reduction in value.
In the event that a payment is not completed or is cancelled by the relevant bank, the Seller's obligation to deliver the product is suspended until payment is confirmed.
If the Buyer's credit card is used fraudulently by an unauthorized third party following delivery, and the bank does not remit payment to the Seller as a result, the Buyer must return the product within 3 days at their own shipping cost.
The Buyer has the right to withdraw from this contract within 7 days of receiving the goods, without providing any reason and without incurring any legal or financial penalty, provided the product has not been used. To exercise this right, the Seller must be notified by email within the same period. Upon confirmation, the product price will be refunded within 10 days.
The right of withdrawal does not apply to products manufactured or personalized according to the Buyer's specific requests — including name necklaces, initial pieces, and custom engravings — nor to products whose price is determined by fluctuations in financial markets.
For shipments to Turkey and the TRNC, any applicable VAT or customs taxes not covered by the Seller are the Buyer's responsibility. The right of withdrawal does not apply to items that have not been cleared from customs.
In the event that either party fails to fulfill its obligations under this agreement, the provisions of Articles 106–108 of the Code of Obligations regarding default shall apply. The non-defaulting party will grant a 7-day remedy period. If the obligation remains unmet, the non-defaulting party may demand performance or terminate the contract and request a full refund.
In cases of force majeure — including but not limited to natural disasters, transport disruptions, fire, or flood — the Seller shall not be held liable for delayed delivery. The Buyer may choose to cancel the order or wait until the obstacle is resolved. In case of cancellation, any amount paid will be refunded within 10 days.
In the event of a dispute arising from this contract, Consumer Arbitration Committees are authorized for claims up to the monetary threshold announced annually by the Ministry of Customs and Trade. Consumer Courts have jurisdiction for disputes exceeding this threshold.
